1. Who we are

Dory Home is a trading name of Thomas David Short, a sole trader (Italian persona fisica operating as a ditta individuale). In these Terms, "Dory", "Dory Home", "we", "us" and "our" mean Thomas David Short trading as Dory Home.

Thomas David Short is the seller and the data controller for the Services.

2. What this page is, and what it is not

The Landing Site is a pre-campaign page that lets you:

• join a waitlist to receive updates about the "Dory Empty Pocket" smart key tray (the "Product"); and / or
• place an optional symbolic reservation deposit of $1 (the "Reservation Deposit") to register your interest and unlock early-bird perks (the "Perks").

The Landing Site is not a shop for the final Product. Using the Services does not create any purchase contract for the Product, and we are under no obligation to manufacture, launch or deliver the Product. The Product may later be offered through a crowdfunding campaign on Kickstarter (the "Campaign") and / or other channels, under separate terms presented at that time.

All timelines, features, descriptions, visuals, renders, technical specifications, prices and Perks shown on the Landing Site are indicative only and may change. For example, the current concept uses a weight (load-cell) sensor and does not use a camera or a microphone, but the final design and feature set are not fixed.

3. Eligibility and age

You must be at least 18 years old, or the age of majority in your country of residence if higher, to use the Services. The Services are not directed to children, and we do not knowingly collect personal data from minors. See our Privacy Policy.

4. Waitlist and communications

If you join the waitlist, we may send you, by email only: product updates, pre-launch announcements, Campaign launch notifications, surveys and validation questions. We do not run SMS or text-message marketing.

You can unsubscribe at any time using the link in any email or by contacting hello@doryhome.com. Unsubscribing from marketing emails does not affect any service message we must send in connection with a Reservation Deposit. The legal bases for these communications are explained in our Privacy Policy.

5. The Reservation Deposit (optional)

The Reservation Deposit is a symbolic signal of interest, not a purchase of the Product. The Reservation Deposit is processed through our store at shop.doryhome.com.

• The Reservation Deposit is fully refundable (see section 7) and is not a payment toward the price of the Product.
• Placing a Reservation Deposit creates no obligation to buy anything.
• The Perks (for example early access, an early-bird discount, or priority updates) are promotional, may change, and may be limited in availability or eligibility to prevent fraud and abuse.
• We may ask you to complete additional steps (for example confirming your email or completing a survey) before a Perk applies.

6. Payments and checkout providers

The Reservation Deposit is collected through our store on Shopify and is processed by Shopify Payments. Your payment is subject to the provider's own terms and privacy notices. We do not receive or store your full card details. See the Store Terms of Service and Store Privacy Policy for more detail.

7. Refund and cancellation of the Reservation Deposit

The Reservation Deposit is fully refundable at any time, on request, with no need to give a reason. During the pre-campaign phase the Reservation Deposit is never converted into an order or a pre-order: no product is sold or shipped at this stage. To request a refund, email hello@doryhome.com from, or quoting, the email address used for the reservation. Refunds are issued to the original payment method without undue delay and in any event within 14 days of the date we receive your request. The Reservation Deposit is not a payment toward the price of the Product and creates no obligation to buy.

If we decide not to proceed with the program, or cannot deliver an advertised Perk, we will refund any Reservation Deposit you have paid, using the same wording and timeframe above. Your statutory rights as a consumer are not affected by this section.

8. No affiliation with Kickstarter

Kickstarter is an independent third party. The Landing Site is not operated, sponsored or endorsed by Kickstarter. Any future Campaign will be governed by Kickstarter's own terms of use and policies, in addition to any terms we present for that Campaign.

9. Changes to the Product and the program

We may modify, delay or cancel: the Product concept, its features, design, app, materials and specifications; the program and the Perks; prices and discounts; and the timing of, or the decision to run, any Campaign. We will try to communicate material changes through the Landing Site or by email. To the maximum extent permitted by law, and subject to your mandatory consumer rights, we are not liable for losses arising from such changes.

10. Acceptable use

When using the Services you must not: use them for any unlawful purpose; interfere with their operation or security; submit false information; or make fraudulent Perk or refund claims. We may suspend access, withhold or invalidate Perks, and cancel a Reservation Deposit (with a refund as set out in section 7) where we reasonably suspect abuse.

11. Intellectual property

All content on the Landing Site, including text, graphics, images, logos, renders and their selection and arrangement, is owned by us or our licensors and is protected by Italian, European Union and applicable foreign intellectual property laws. You may view the content for your personal, non-commercial use only. You may not copy, reproduce, distribute, modify or otherwise reuse it without our prior written permission.

12. Privacy and cookies

We process personal data (for example your email address, technical and analytics identifiers, and Reservation Deposit data) in accordance with our Privacy Policy and your cookie choices. In line with the GDPR (Regulation (EU) 2016/679), the Italian ePrivacy rules and the 2021 cookie guidelines of the Italian data protection authority (the "Garante"), non-essential analytics cookies are off by default and can be enabled, changed or rejected at any time through our cookie banner and preference centre. We do not use advertising or profiling cookies. See our Cookie Policy.

13. Disclaimers

The Services are provided "as is" and "as available". We do not warrant that the Landing Site will be uninterrupted, secure or error free, or that any Campaign will launch or succeed. Nothing in this section limits any warranty or right that you have under mandatory consumer law.

14. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss arising from your use of the Services. Where we are found liable, our total liability to you will not exceed the amount of any Reservation Deposit you have paid.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. If you are a consumer, your mandatory statutory rights are not affected by this section.

15. Governing law and jurisdiction

These Terms are governed by Italian law. If you are a consumer, any dispute arising from these Terms falls under the exclusive jurisdiction of the court of the place where you are resident or domiciled, under Article 66-bis of the Italian Consumer Code (Legislative Decree 206/2005). If you are not acting as a consumer, the courts of Rieti (Tribunale di Rieti), which covers Montopoli di Sabina, have exclusive jurisdiction.

If you are a consumer resident in the European Union, this choice does not deprive you of the protection of the mandatory consumer-protection rules of your country of residence, and you may also bring proceedings in the courts of your place of residence. EU distance-selling rights under Directive 2011/83/EU, as implemented in Italy by Legislative Decree 206/2005 (the "Consumer Code"), are preserved.

For out-of-court resolution, consumers may use the alternative dispute resolution (ADR) bodies available in their country. Note: the European Commission's Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025 (Regulation (EU) 2024/3228 repealing Regulation (EU) 524/2013), so no ODR link is provided.

16. Changes to these Terms

We may update these Terms from time to time. The "Effective date / Last updated" line above shows when they last changed. Material changes will be communicated where required by law. Continued use of the Services after an update means you accept the revised Terms.
